These Terms and Conditions ("Terms") govern your access to and use of our website located at www.thesvarna.com, our mobile applications, and all related services, including the purchase of jewellery and accessories (collectively, the "Services").

By accessing our website, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, please discontinue your use of our Services immediately.

These Terms constitute a legally binding agreement between you ("Customer", "you", or "your") and The Svarna, a company registered under the laws of India.

3. Eligibility & Account Registration

3.1 Age Requirement

Our Services are available only to individuals who are 18 years of age or older and legally capable of entering into a binding contract under applicable law. Minors under 18 must have the consent and supervision of a parent or legal guardian to use our Services.

3.2 Account Registration

To place an order or access certain features of our website, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information to keep it accurate
  • Keep your password confidential and not share it with any third party

4. Products & Product Descriptions

4.1 Jewellery Authenticity

All jewellery sold by The Svarna is crafted using authentic, high-quality materials including but not limited to gold, silver, platinum, diamonds, gemstones, and semi-precious stones. Each product listing specifies the metal purity (e.g., 9KT, 14KT, 18KT, 22KT, 925 Sterling Silver), stone quality, and weight wherever applicable.

4.2 Hallmarking & Certification

All gold jewellery sold through The Svarna complies with the Bureau of Indian Standards (BIS) Hallmarking regulations as mandated by the Government of India. Certifications from recognized gemmological laboratories (e.g., GIA, IGI, DHC) are provided where applicable for diamonds and precious gemstones.

4.3 Product Representations

We endeavour to display product images and descriptions as accurately as possible. However, please note:

  • Actual colours of jewellery may vary slightly from on-screen representations due to monitor/display settings and photographic lighting
  • Weights mentioned are approximate and may vary marginally due to the handcrafted nature of the pieces
  • Customised or made-to-order pieces are subject to slight variations from sample images
  • Stone sizes and counts are approximate and may vary within industry-standard tolerances

4.4 Availability

All products are subject to availability. The Svarna reserves the right to discontinue, modify, or limit the quantity of any product without prior notice. In the event a product becomes unavailable after you place an order, we will notify you promptly and offer either a full refund or an alternative product.

 

5. Pricing, Taxes & Duties

5.1 Indian Orders

All prices displayed on our website for orders within India are inclusive of Goods and Services Tax (GST) as applicable under Indian law. The applicable GST rate on jewellery and precious metals is as per the prevailing schedule under the GST Act.

5.2 International Orders

For international orders, prices displayed are exclusive of customs duties, import taxes, and any applicable local levies. The customer is solely responsible for all import duties, customs clearance fees, and local taxes levied by the destination country's customs authority. The Svarna is not liable for delays caused by customs clearance procedures.

5.3 Dynamic Pricing

Prices for gold and platinum jewellery are subject to variation based on prevailing metal market rates (MCX / international spot prices). Prices confirmed at the time of order placement shall be honoured for a period of 24 hours from order confirmation. If there is a significant fluctuation (above 3%) in metal prices prior to dispatch, we reserve the right to revise the invoice with prior intimation to the customer.

5.4 Currency

All prices are listed in Indian Rupees (INR ₹) for domestic orders. International customers may view prices in their local currency (converted at prevailing exchange rates) for reference; however, all charges will be processed in INR. Your bank or payment provider may apply foreign exchange fees.

5.5 Errors in Pricing

While we take every precaution to ensure pricing accuracy, errors may occasionally occur. The Svarna reserves the right to cancel any order placed at an erroneously displayed price and will notify you promptly with an option to reorder at the correct price or receive a full refund.

 

6. Orders & Order Processing

6.1 Order Placement

By placing an order on The Svarna, you make an offer to purchase the selected product(s) subject to these Terms. An order is confirmed only upon receipt of a written order confirmation email from us. The Svarna reserves the right to accept or decline any order at its sole discretion.

6.2 Order Confirmation

Upon successful placement of your order, you will receive an automated acknowledgement email. This acknowledgement does not constitute acceptance of the order. Acceptance occurs when we send a formal Order Confirmation email along with an invoice.

6.3 Cancellation by Customer

Orders may be cancelled by the customer within 24 hours of placement without any cancellation charge, provided the item has not been dispatched. For made-to-order or customised pieces, cancellation is not permitted once the manufacturing process has commenced. Please contact connect@thesvarna.com immediately to request cancellation.

6.4 Cancellation by The Svarna

The Svarna reserves the right to cancel orders in the following circumstances:

  • Product is out of stock or discontinuation has been announced
  • Pricing error has been identified on the product listing
  • Payment verification failure or suspected fraudulent transaction
  • Inability to deliver to the specified address
  • Any other reason at our sole discretion with full refund to the customer

 

7. Payment Terms

7.1 Accepted Payment Methods

The Svarna accepts the following payment methods for domestic (India) orders:

  • Credit Cards & Debit Cards (Visa, Mastercard, RuPay, American Express)
  • Net Banking (all major Indian banks)
  • UPI Payments (Google Pay, PhonePe, BHIM UPI, Paytm)
  • EMI options on select banks and NBFCs (subject to eligibility)
  • Buy Now Pay Later (BNPL) schemes via partner platforms

For international orders, we accept:

  • International Credit & Debit Cards (Visa, Mastercard, American Express)
  • Wire Transfer / SWIFT (for high-value orders above ₹5,00,000)
  • PayPal (selected countries)

7.2 Payment Security

All transactions on The Svarna are processed through SSL-encrypted payment gateways compliant with PCI-DSS (Payment Card Industry Data Security Standard). Your payment details are never stored on our servers. We use industry-leading payment processors to ensure the highest level of security.

7.3 EMI Terms

EMI options are subject to bank/NBFC approval and applicable processing fees. The interest rate and tenure are as per the lending institution's policy. The Svarna is not responsible for any EMI-related disputes between you and your financial institution.

7.4 Invoice & GST

A valid GST-compliant tax invoice will be issued for every purchase and sent to your registered email address. For Business customers requiring HSN code or specific invoice formats, please contact us prior to placing the order.

 

8. Shipping & Delivery Policy

8.1 Domestic Shipping (India)

The Svarna ships to all states and union territories of India through trusted, insured logistics partners. Standard delivery timelines are as follows:

  • Metro cities (Mumbai, Delhi, Bengaluru, Chennai, Hyderabad, Kolkata, Pune): 3–5 business days
  • Tier II & Tier III cities: 5–8 business days
  • Remote / Rural areas: 8–12 business days
  • J&K, North-Eastern states, and island territories: 10–15 business days

Express shipping options (1–2 business days) are available for select pin codes at an additional charge.

 

8.2 International Shipping

The Svarna ships worldwide to over 100 countries. International delivery timelines:

  • USA, UK, Canada, Australia, Singapore, UAE: 7–14 business days
  • Europe (EU countries): 10–15 business days
  • Other international destinations: 14–21 business days

All timelines are indicative and subject to customs clearance delays, public holidays, and logistical conditions beyond our control.

8.3 Shipping Charges

Complimentary insured shipping is offered on all domestic orders. International shipping charges are calculated based on the destination country, package weight, and dimensions, and will be displayed at checkout before payment.

8.4 Packaging

All jewellery from The Svarna is dispatched in our signature branded packaging — a luxury jewellery box with a The Svarna authenticity card, care guide, and a tamper-evident security seal. The outer packaging is discreet for security purposes and does not indicate the contents.

8.5 Insurance & Risk

All shipments are fully insured up to the declared value of the package while in transit. Risk of loss or damage passes to the customer upon delivery and acceptance of the package. For international shipments, the customer bears the risk of customs-related delays or confiscations, subject to applicable laws of the destination country.

8.6 Tracking

Once your order is dispatched, you will receive a shipment tracking number and courier details via email and/or SMS. You can track your order on our website under 'Order Tracking' or directly on the courier's website.

8.7 Non-Delivery

If a shipment is undelivered due to an incorrect address provided by you, refusal of delivery, or failure to collect from a courier facility within the stipulated period, the package may be returned to us. In such cases, re-shipping charges will apply. For international orders, customs seizure due to import restrictions is the sole responsibility of the customer.

 

9. Returns, Exchanges & Refunds

9.1 Return Policy

The Svarna offers a 7-day return policy from the date of delivery for ready-to-ship products, subject to the following conditions:

  • The product must be unused, unworn, and in its original condition with all tags and authenticity documentation intact
  • The original branded packaging, box, certificates, and invoice must be included
  • The product must not have been altered, sized, engraved, or customised after delivery
  • A return request must be raised within 7 days of delivery by emailing connect@thesvarna.com with your order number and reason

9.2 Non-Returnable Items

The following items are not eligible for return or exchange:

  • Customised, personalised, or made-to-order jewellery (including items with engraving, special sizing, or custom design)
  • Earrings and nose pins (for hygiene reasons)
  • Items purchased during final sale, clearance, or promotional events clearly marked as non-returnable
  • Gift cards and vouchers
  • Items that have been worn, damaged, or altered by the customer

9.3 Exchange Policy

The Svarna facilitates a one-time exchange on eligible products within 30 days of delivery, subject to availability. The exchanged item must be of equal or higher value; for items of higher value, the differential amount must be paid by the customer. For items of lower value, the differential will be issued as a store credit.

9.4 Refund Process

Upon receipt and quality inspection of the returned item (typically completed within 3–5 business days of receipt at our facility), refunds will be processed as follows:

  • Original payment method (credit card / debit card / net banking / UPI): 5–10 business days
  • Bank wire transfer (for cash-on-delivery or international wire payments): 7–14 business days
  • Store credit / gift voucher: Issued within 24 hours of return approval

Shipping costs for returns are borne by the customer unless the return is on account of a defective or incorrect item dispatched by The Svarna.

9.5 Defective or Incorrect Products

In the unlikely event that you receive a defective, damaged, or incorrect product, please notify us within 48 hours of delivery with photographic evidence. The Svarna will arrange a complimentary reverse pickup and provide a full refund or replacement at no additional cost to you.

 

10. Warranty & Quality Assurance

The Svarna stands behind the craftsmanship and quality of every piece. All jewellery sold through The Svarna comes with the following warranty coverage from the date of purchase:

  • Manufacturing Defects: 6-month warranty covering any defects arising from the manufacturing process (broken clasps, loose prongs, defective soldering)
  • Rhodium/Gold Plating: 6-month warranty on plating for silver jewellery under normal use conditions

The warranty does not cover:

  • Normal wear and tear, scratches, or patina over time
  • Damage due to misuse, accident, negligence, or improper storage
  • Jewellery that has been repaired, resized, or altered by a third party
  • Stone loss due to physical impact or abrasion

11. International Orders & Compliance

11.1 Export Compliance

The Svarna complies with Indian export regulations including the Foreign Exchange Management Act (FEMA), 1999, and applicable RBI guidelines on cross-border e-commerce payments. All exports are conducted in compliance with the Foreign Trade Policy of India.

11.2 Import Responsibility

International customers are responsible for ensuring that the product can be legally imported into their country. The Svarna is not liable for confiscation, delay, or destruction of goods by customs authorities. Customers should check local import restrictions on precious metals and jewellery before placing an international order.

11.3 Customs Declarations

The Svarna will declare the correct and actual value of the shipment on all customs documents as required by law. We do not under-declare shipment values or misrepresent goods on customs documentation.

11.4 Restricted Countries

The Svarna does not ship to countries under international sanctions, embargoes, or trade restrictions as imposed by the Government of India, the United Nations, the United States Office of Foreign Assets Control (OFAC), or other applicable authorities. A current list of restricted destinations is available on request.

 

12. Intellectual Property Rights

All content on The Svarna website, including but not limited to text, images, logos, product photographs, design elements, jewellery designs, graphics, audio clips, and software, is the exclusive intellectual property of The Svarna or its licensed partners and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, the Designs Act, 2000, and other applicable Indian and international intellectual property laws.

You are expressly prohibited from reproducing, distributing, modifying, creating derivative works of, displaying, or using any content from this website for commercial purposes without obtaining prior written consent from The Svarna. Any unauthorised use shall constitute an infringement of our intellectual property rights and may result in legal proceedings.

13. Privacy & Data Protection

The collection, use, and protection of your personal information is governed by our Privacy Policy, which forms an integral part of these Terms and is incorporated herein by reference. By using our Services, you consent to the processing of your personal data as described in the Privacy Policy.

The Svarna complies with the Information Technology (Amendment) Act, 2008, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Digital Personal Data Protection Act, 2023 (as applicable), in protecting your personal and financial data.

14. Prohibited Uses

You agree not to use The Svarna's Services for any of the following prohibited purposes:

  • Engaging in any fraudulent, deceptive, or misleading activity
  • Placing orders using stolen or unauthorised payment credentials
  • Reselling or bulk-purchasing products without prior commercial arrangement with The Svarna
  • Using automated bots, scrapers, or data-mining tools to access our website
  • Attempting to hack, breach, or compromise our website's security infrastructure
  • Violating any applicable local, state, national, or international laws or regulations
  • Engaging in any activity that disrupts or interferes with the normal functioning of our Services
  • Impersonating any person or entity, including The Svarna personnel

15. Limitation of Liability

To the maximum extent permitted by applicable law, The Svarna's total liability to you for any claim arising out of or related to these Terms or your use of our Services shall not exceed the amount actually paid by you for the specific product or service giving rise to the claim.

The Svarna shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, goodwill, data, or business opportunities, even if advised of the possibility of such damages. This limitation applies whether the liability arises from contract, tort (including negligence), strict liability, or any other theory.

Nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded or limited under applicable consumer protection laws, including the Consumer Protection Act, 2019 (India).

 

16. Governing Law & Dispute Resolution

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. The courts of competent jurisdiction in Tamil Nadu, India shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms or your use of our Services.

16.2 Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or any breach thereof, the parties shall first attempt to resolve the matter amicably through good-faith negotiations. If the dispute cannot be resolved within 30 days of written notice, either party may refer the matter to arbitration in accordance with the Arbitration and Conciliation Act, 1996 (India), with a sole arbitrator mutually appointed. The seat of arbitration shall be Tamil Nadu, India, and proceedings shall be conducted in the English language.

16.3 Consumer Forum

Notwithstanding the above, nothing in these Terms prevents you from filing a complaint with the appropriate Consumer Disputes Redressal Forum / Commission as per the Consumer Protection Act, 2019 (India). You may also use the National Consumer Helpline or the e-DAAKHIL portal for online complaint filing.

 

17. Changes to Terms & Conditions

The Svarna reserves the right to modify, update, or replace these Terms at any time at its sole discretion. The revised Terms will be posted on our website with a new "Last Updated" date. Significant changes will be communicated to registered customers via email.

Your continued use of our Services after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, please discontinue using our Services and contact us to close your account.

18. Force Majeure

The Svarna shall not be held liable for any delay or failure in performance resulting from circumstances beyond our reasonable control, including but not limited to: acts of God (floods, earthquakes, cyclones), pandemic or epidemic events, government-imposed lockdowns or trade restrictions, strikes or labour disputes, failure of third-party logistics providers, internet or telecommunications outages, or acts of war or terrorism.

In such events, we will notify you as soon as practicable and work to fulfil your order at the earliest opportunity. You may cancel your order and receive a full refund if the delay exceeds 30 days.

19. Miscellaneous Provisions

19.1 Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, Return Policy, and any other policies referenced herein, constitute the entire agreement between you and The Svarna with respect to the subject matter hereof and supersede all prior agreements, representations, and understandings.

19.2 Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the enforceability of the remaining provisions.

19.3 Waiver

The Svarna's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative of The Svarna.

19.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without The Svarna's prior written consent. The Svarna may assign these Terms in connection with a merger, acquisition, or sale of assets.

19.5 Language

These Terms are drafted in the English language. In the event of any conflict between an English version and a translated version, the English version shall prevail.
